O presente artigo tem por escopo examinar a tensão entre regulamentação e liberdade de mercado na União Europeia, por meio do estudo do Acórdão do TJUE no caso “Champagner Sorbet”, que aborda o mercado interno europeu, sustentáculo instrumental de integração da União, com enfoque na política adotada pelos mercados agrícolas e questões relacionadas às Denominações de origem protegida. O enfoque singe-se à participação ativa no projeto de integração europeia do pensamento ordoliberal e o importante papel do TJUE na salvaguarda da (...) independência da organização do mercado comum. Talmy divided the world’s languages according to how they express movement. Spanish, a verb-framed language, purportedly constrains the use of motion verbs expressing the manner of movement (such as roll) to contexts in which no spatial boundary is crossed. Previous research suggests that this constraint sometimes does not apply. We report the first large-scale investigation of the constraint and its modulating factors (movement direction, verb type, entering/exiting, Ground size, the preposition used) across different Spanish-speaking communities. A task with open-ended description (...) of animated videos, a sentence interpretation task, and a rating task found that Spanish and Latin American speakers (n = 180 in total) often use manner verbs to describe boundary-crossing situations (especially entering a place), although this is modulated by the preposition following the verb (more with a than en). Better understanding of this constraint in verb-framed languages has applications in, for instance, L2 acquisition research. (shrink)

Of the many ways of getting at the core of the weirdnesses in quantum mechanics, there’s one which traces back to Schrödinger’s seminal 1935 paper, and has to do with the apparent fuzzy nature of the reality described by the formalism through the wavefunction $$\psi$$ ψ. This issue, which I will be calling the Determinacy Problem, is distinct from the standard measurement problem of quantum mechanics, despite Schrödinger himself ends up conflating the two. I will argue that the Determinacy Problem (...) is an exquisitely philosophical problem, for as it is standard when facing any phenomenon which appears to have indeterminate or fuzzy characteristics, the solutions available are to either blame the deficiencies of our language, or our lack of knowledge, or to blame the world itself. These three attitudes can already be found in the literature on quantum mechanics, either explicitly or implicitly, and they appear to motivate three very distinct research programs: high-dimensional realism, primitive ontology, and quantum indeterminacy. Après l’analyse du problème du corps dans les écrits levinassiens de jeunesse, problème que nous avons exposé dans un précédant numéro de la revue ( Les Études Philosophiques, vol. 113 (2013), n o 2, pp. 201-219), nous nous focalisons dans cet article sur la période moyenne de l’œuvre de Levinas, et notamment sur Totalité et Infini. La corporéité est ici caractérisée constamment par une sorte d’ambivalence, la dimension incarnée du sujet étant souvent placée dans une certaine ambiguïté. Nous essayerons de (...) montrer comment la corporéité, toujours équivoque, fait intimement partie de la relation originaire du sujet avec le monde, avec soi-même et avec l’autre. Pour cela, nous étudierons plusieurs rapports essentiels où intervient le problème de la chair : entre le corps et la conscience, entre le corps et l’élément, entre le corps et l’habitation, entre le corps et le travail, et, finalement, entre le corps et l’autre. O objetivo deste ensaio é refletir sobre o significado da expressão “arte do paladar”, enfocando os aspectos da nossa história evolutiva – uma história contemporaneamente biológica e cultural – os quais fizeram de nós os únicos “macacos” capazes de cozinhar o alimento, de produzi-lo de modo sistemático, de escolhê-lo em meio a uma vasta gama de alimentos, com base em diferentes critérios, de atribuir-lhe um valor simbólico e de celebrálo através da linguagem; razões pelas quais o homem pode reivindicar plenamente (...) a invenção dos sabores. Resultado de um longo processo de elaboração da natureza, a arte do paladar é, portanto, o resultado de todos os processos pelos quais transformamos um dos atos mais naturais, isto é, o ato de comer, em um artificial, cultural e intelectual, aplicando um conhecimento, um saber prático, para conceber, imaginar e elaborar novos objetos alimentares, novas sensações para o paladar, novas possibilidades de interação social. En este trabajo me propongo analizar algunos de los argumentos de John Rawls en contra de un principio de diferencia internacional, tal como fueron presentados en Un derecho de gentes. Sostengo que estos argumentos son inconsistentes con el principio de diferencia doméstico. Si los aceptamos, entonces tendremos que afrontar el dilema de o bien tener que aceptar dicho principio distributivo en ambos ámbitos (el doméstico y el internacional) o bien tener que rechazarlo por completo. También sostengo que las posibles objeciones (...) de Rawls a esta crítica se basan en la dudosa premisa empírica de que los países son exclusivamente responsables de su propio fracaso. In this paper I will analyze John Rawls's claims against an international difference principle as presented in The Law of Peoples. I argue that these claims are inconsistent with the difference principle itself. If we accept them, then we will face the dilemma of either having to endorse this principle both in the domestic and the international domains or having to reject it completely. I also defend the view that Rawls's possible reply to this objection relies on the dubious empirical premise that countries are blameworthy for their own failure. (shrink)

The general idea of this investigation is to emphasize the elusiveness of the concept of terrorism and the pitfalls of the so-called “War on Terror” by way of confronting, roughly, the reflections made in the immediate following of 9/11 by Habermas and Derrida on the legacy of Enlightenment, globalization and tolerance, with Foucault’s concept of biopolitics seen as the modern political paradigm and Agamben’s understanding of “the state of exception” in the context of liberal democratic governments. The main argument will (...) state that the modern Western individual and the modern terrorist are in a way linked together as products of the same biopolitical network. So I shall argue that religious fundamentalism and international terrorism are not external factors to the Western civilization, nor even some radical late forms of ‘Counter-Enlightenment’ threatening the Western ‘way of life,’ but phenomena revealing what we could call, borrowing J. Derrida’s biological metaphor, a “crisis of autoimmunization” of Western neo-liberal democracies. The only long-term solution to the threat of global terrorism would have to involve the “deconstruction” of our common notion of tolerance and the experience of an unconditional hospitality that is actually the inversion of the terrorist action that is threatening us “from within,” according to Derrida. But we cannot reasonably hope for this radical change in our relationship to others unless we aren’t really trying to modify the relationship to the self that is prevalent in contemporary Western societies: a vision of us as self-encapsulated monads or ‘nuclear’ selves, for whom genuine community life is, at the most, only a nostalgic evocation of a past long gone, and the respect for the others, a strategic name for moral indifference. The encounter of different cultures characterizes liberal-democratic societies in the era of economic and technological lobalization. The interference of new technologies and the relationship between them and the diverse cultures could give rise contrasting ways of giving and doing justice. The fundamental thesis, which I intend to put forward, is that the relation between culture and justice within the «Global Technological Society» is quite profound and requires the adoption of contemporary forms of normativity, both thin and thick,in such way as (...) to allow the recognition of those cultural and intercultural elements, which are present in the concept of justice. The objective of our research is to examine the diverse methods of judicial interpretation, taking off from that established in Article 4 of the Venezuelan Civil Code. We attempt to explain what and how to interpret using the exegetic method of interpretation through an exhaustive analysis of the article, in agreement with Article 22 of the Penal Process Organic Code. Emphasis is placed on the classical methods of legal interpretation: grammatical, logical-systematic, and historical-comparative, among others.

An idea is a public good. The use of an idea by one person does not hinder others to benefit from the same idea. However in order to generate new life-saving ideas, e.g. inventions in the life sciences, a huge amount of human and material resources are needed. Powerful, but highly criticized tools to speed up the rate of innovation are exclusive rights, most prominently the use of patents and plant breeders’ rights. Exclusive rights leave by nature a number of (...) people empty-handed, with starvation, stuntedness, prevalence of disease and death as preventable and quotidian consequences. To stimulate a human rights compatible use of exclusive rights a wide range of moral frameworks have been developed to condemn current praxes. Most prominent in the debate are theories building on (1) utilitarian calculations of weighing benefits with Peter Singer as a prominent advocate, (2) Pogge’s vindication of compensatory duties for institutional harms, (3) a comprehensive analysis on how the current innovation incentive system fails to secure human rights and human capabilities and lastly (4) showing how the status quo nurtures misrecognition. With help of those theories modest targets as well as a thorough restructure of the innovation incentive system can be justified. Those theories have the mammoth task of restraining well-established ideas supporting the permissibility of a reckless use of property rights that are deeply anchored in the property law discourse. Life sciences raise a range of special problems when justifying pro-poor innovation. Healthy people living in a society with a good sanitary infrastructure need far less resources to tackle health problems than people in places with a poor infrastructure. Patents that involve gene sequences (or part thereof) make inventing around impossible, making the seeking of licenses mandatory for investigators wanting to make follow-up research with the molecule. Speedy sharing of data concerning public health hazards or threats to food security are vital to maintain living standards. (shrink)

Which political-philosophical attitude is implicit in the International and European environmental legislation for reducing and preventing the environmental degradation? The concepts and means, developed to compare us with the environmental issue, are adequate to capture the reality of these emergencies? The basic thesis, I intend to discuss and defend, argues that there is a “question incompatibility” between political liberalism and environmental protection.

Este trabajo analiza la relevancia de la noción de capacidad contributiva en una concepción igualitaria de la justicia y en particular si puede concebirse como una garantía que deriva de la protección de ciertas libertades básicas consideradas prioritarias. Se argumenta que no tiene este lugar y que por lo tanto la imposición de tributos no debe respetar esta restricción ya que no existe libertad básica que sea protegida por el principio de "capacidad contributiva". This paper discusses the relevance of the (...) notion of "ability to pay" in an egalitarian conception of justice and particularly whether it could play a role as a guarantee that derives from a requirement of protection of certain basic liberties considered as priorities. It is argued that it does not have this place, thereby tax policies should not respect this constraint because there is no liberty protected by the "ability to pay" principle. (shrink)

The technological control of female bodies and the bio-political control of artificial reproduction have become central issues within feminist philosophical thinking, becoming an obligatory point of reference toward deepening the conceptual, political, social and symbolic connection between women's bodies and assisted reproductive technologies (ARTs). In this essay, my attention will be focused primarily on eco-feminist theses that firmly oppose the diffusion of assisted reproductive technologies and the legitimization of «pregnancy contracts». According to the «resistance eco-feminists», (those against ARTs), the process (...) of assisted reproduction does not expand procreative rights, does not free women from infertility, nor does it enable them to truly experience of motherhood. Behind the therapeutic paradigm within which reproductive technologies justify themselves, there hides a bio-power that has refined the tools necessary in order to wrest control of the reproductive experience from women. The colonization of women thusly proceeds along with the colonization of nature and life. The selection of fertile elements involves the biological-genetic and social dissection of living organisms, be they plants or animals: the woman, sectioned and fragmented, becomes a composite human being, a «dividual» being rather than an individual. Very large databases are a major opportunity for science and data analytics is a remarkable new field of investigation in computer science. The effectiveness of these tools is used to support a “philosophy” against the scientific method as developed throughout history. According to this view, computer-discovered correlations should replace understanding and guide prediction and action. Consequently, there will be no need to give scientific meaning to phenomena, by proposing, say, causal relations, since regularities in very large databases are enough: “with (...) enough data, the numbers speak for themselves”. The “end of science” is proclaimed. Using classical results from ergodic theory, Ramsey theory and algorithmic information theory, we show that this “philosophy” is wrong. For example, we prove that very large databases have to contain arbitrary correlations. These correlations appear only due to the size, not the nature, of data. They can be found in “randomly” generated, large enough databases, which—as we will prove—implies that most correlations are spurious. Too much information tends to behave like very little information. The scientific method can be enriched by computer mining in immense databases, but not replaced by it. (shrink)

The organizational account of biological functions interprets functions as contributions of a trait to the maintenance of the organization that, in turn, maintains the trait. As has been recently argued, however, the account seems unable to provide a unified grounding for both intra- and cross-generation functions, since the latter do not contribute to the maintenance of the same organization which produces them. To face this ‘ontological problem’, a splitting account has been proposed, according to which the two kinds of functions (...) require distinct organizational definitions. In this article, we propose a solution for the ontological problem, by arguing that intra- and cross-generation functions can be said to contribute in the same way to the maintenance of the biological organization, characterized in terms of organizational self-maintenance. As a consequence, we suggest maintaining a unified organizational account of biological functions. (shrink)

Elaboramos una versión del disposicionalismo experimental que esclarece la relación entre capacidades y leyes fenomenológicas. Tras algunas consideraciones introductorias, presentamos el disposicionalismo experimental en vistas de las nociones de modalidad física y ambiente de estímulo. Trazamos las líneas generales para una epistemología experimentalista de las capacidades y esclarecemos la modalidad física e invariancia de las leyes fenomenológicas. Luego examinamos las generalizaciones físicas y extrapolaciones de las leyes fenomenológicas y exponemos el caso de la ley de Fresnel, que ilustra aspectos de (...) nuestro argumento. A tension between solidity and fluidity tends to divide the sciences and the humanities along lines that define what is hard and soft in knowledge. This divide relates to similar dichotomies, between exteriority and interiority, material and spiritual, homogeneity and heterogeneity, matter and form, all of which have been partially mapped in Western thinking onto a traditional separation between earth and sky. Yet particular forms of knowledge sit uneasily within these tensions, a paradigmatic example of which is an understanding of (...) solids as ‘viscous fluids’. This article explores the concept of viscosity, attending to how it has impacted on understandings of matter, as well as broader social and cultural issues. It does so, particularly, by looking into the scientific study of ice, a material that has historically been regarded as solidfluid, to argue that life and sociality remain possible only in so far as matter that is viscid allows solid and fluid states to mingle. In this article I discuss the conditions under which sovereign debts are not morally binding for a state. Following an old legal doctrine, I call non-binding debts ‘odious'. I proceed as follows. First, I argue that alternative accounts on the morality of debts are unsatisfactory. The problem these accounts have are that they do not clearly identify the philosophical issues that underlie the notion of odious debts, or that they fail to specify what exactly the immorality of odious debts consists (...) in. Second, I defend the view that a debt is odious when two conditions are satisfied: borrowed funds were used by public officials for purposes for which they were not authorised lenders knew, or should have known, about possible unauthorised uses of those funds. If these two conditions are both satisfied, debts should not be considered debts of the state, but rather personal debts of rulers. Is it justified to hold that an agent S has a (moral) right to P if the duty-bearer is not specified? There is an intense ongoing debate on this question. There are two positions in the literature. On the one hand, O´Neill´s much-discussed account of rights holds that it is justified to say that an agent S has a right to P if and only if the duty-bearer is sufficiently determined – i.e. if and only if it is clear against (...) whom S may claim her right to P (O’Neill 1986, 1988, 1996, 2000, 2005, 2016). Call this, the ‘claimability condition’. On the other hand, interest-based theorists argue that it can be justified to say that an agent S has a right to P even if the duty-bearer is not sufficiently determined (Caney 2007; Griffin, 2008; Raz 1988; Tasioulas 2007; see also: Etinson, 2013; Ypi 2010). Who (if anyone) is correct in this fundamental discussion about the very nature of rights? In this paper, I provide an answer to this crucial question. Neither O´Neill nor interest-based theorists provide good reasons to justify their positions. However, I argue, the claimability condition is an existence condition of rights justified on the basis of their action-guiding character. The reason is that if the duty-bearer is not specified, the content of the right (its correlative obligation) does not sufficiently guide what the agent should do because it is indeterminate who is required to act (or refrain from acting). Wodak (2019) persuasively argues that we are not justified in believing that well-being measurements are linear. From this, he infers grave consequences for both political philosophy thought experiments and empirical psychological research. Here I argue that these consequences do not follow. Wodak’s challenges to the status of well-being measurements do not affect thought experiments, and well-being empirical researchers may be justified in making average comparisons even if their measurements are not linear.

The debate about how neurotechnologies impact authenticity has focused on two inter-related dimensions: self-discovery and self-creation. In this paper, we develop a broader framework that includes the experimental and relational dimensions of authenticity, both understood as decisive for shaping one’s narrative identity. In our view, neurointerventions that alter someone’s personality traits will also impact her very own self-understanding across time. We argue that experimental authenticity only needs a minimum conception of narrative coherence of the self and that reversibility should remain (...) a key feature in the ethical assessment of neurotechnologies. The relational dimension of authenticity derives from the fact that a process of self-constitution is never a solitary business. The significant others act not just as subsequent judges of one’s life decisions, but as real co-authors of one’s self. We discuss relevant cases in which others are actively contributing to the meaning-making process, as to the direction one’s life is taking. We also claim that the experimental and the relational dimensions of authenticity should aim to correct each other. The relational dimension introduces socially approved standards as well as limitations to the array of available possibilities of self-fashioning or human enhancement. The experimental side enables us to avoid confusing one’s personal identity with a social and narrative construct that only bears the mark of social pressure and conformism. (shrink)

In this article, I focus on the problem of body as it is developed in Heidegger’s Zollikon Seminars, in contrast with its enigmatic concealment in Being and Time. In the first part, I emphasize the implicit connection of Heidegger’s approach of body with Husserl’s problematic of Leib and Körper, and with his phenomenological analyses of tactility. In the second part, I focus on Heidegger’s distinction between the limits of the lived body and the limits of the corresponding corporeal thing, opening (...) to an ontological understanding of the ecstatic bodying forth of the body. In the third part, I analyse this ecstatic bodiliness in relation to the problem of spatiality, exploring the tension between the here and the over there in the experience of the embodiment. Heidegger not only refuses to understand the space starting from the here of the body, but he also refuses to understand the body starting from the here of the space. Thus, there are two interconnected inversions that Heidegger operates in relation to Husserl: In the topic of spatiality, he rejects the pre-eminence of the here; in relation to the body, he contests the primacy of tactility. Finally, the conclusion stresses that, even if the bodying forth penetrates almost all behaviour of Dasein in the world, there is however a limit of embodiment, an unreachable frontier beyond any possibility of the bodying forth, namely the understanding of being. This also implies that the problem of body needs be understood in the context of the ontological difference. (shrink)

El objetivo de la investigación es interpretar el discurso de psicólogos/as que ejercen docencia para la carrera de Psicología en una(s) Universidad(es) Estatal, Privada con Aporte y Privadas de la V Región, Chile, desde un enfoque de subjetividad laboral. Se realizan 6 entrevistas en profundidad a Psicólogos/as y análisis de discurso. El capitalismo académico produce un elevado número de docentes con flexibilidad laboral contractual o trabajo no decente, pues no existe: estabilidad laboral, derecho a sindicalización, vacaciones periódicas pagadas, ni protección (...) social. Estas condiciones son invisibilizadas en el debate sobre la calidad de la Educación. En este contexto, la subjetividad laboral del malestar docente se expresa como: agotamiento, estrés e incertidumbre vital que hace más difícil el trabajo de formación de futuros/as psicólogos/as en la V Región y en el país.
